Terms and Conditions — Hogani Jets

Welcome to Hogani Jets. These Terms and Conditions ("Terms") govern your access to and use of the Hogani Jets website, services, and private aviation charter offerings.

By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree, please discontinue use of our services.

1. Definitions

  • "Hogani Jets," "we," "our," or "us" refers to Hogani Jets, LLC and its affiliated entities.
  • "User," "you," or "your" refers to any individual or entity accessing our website or services.
  • "Services" include private jet charter brokerage, travel coordination, flight booking assistance, and related aviation services.
  • "Charter Agreement" refers to the separate Charter Terms and Conditions agreement executed for each specific charter booking.

2. Use of Website

You agree to use the website only for lawful purposes and in accordance with these Terms.

You must not:

  • Use the website for fraudulent purposes
  • Attempt unauthorized access to systems, servers, or data
  • Disrupt or interfere with website functionality or security
  • Upload malicious software, viruses, or other harmful content
  • Misrepresent identity or booking information
  • Scrape, crawl, or use automated bots to extract data from the website
  • Reverse engineer, decompile, or attempt to derive the source code of the website or any of its features
  • Use the website to send unsolicited communications to others

We reserve the right to suspend or terminate access for violations, and to pursue all available legal remedies.

3. Charter Services

Hogani Jets acts as a Part 135 air charter broker, connecting clients with independently licensed aircraft operators. Hogani Jets is not a direct air carrier and does not operate aircraft.

Important Notes:

  • All charter flights are operated by Part 135 or equivalent foreign-certificated direct air carriers holding current Air Carrier Certificates.
  • Aircraft availability, schedules, and pricing may change without notice.
  • Operational control of every flight rests with the direct air carrier operating the aircraft.

4. Booking and Payments

  • Charter quotes are subject to aircraft availability and operational approval.
  • A booking is confirmed only after written confirmation and required payment.
  • Payment terms, deposits, and cancellation policies will be provided during booking.

Charter Agreement. All confirmed charter flights are subject to a separate Charter Terms and Conditions agreement provided at the time of booking. In the event of any conflict between these website Terms and the Charter Agreement, the terms of the Charter Agreement shall control with respect to that specific booking.

Additional costs may apply, including but not limited to:

  • Fuel surcharges
  • De-icing fees
  • International permits and overflight fees
  • Landing or handling charges
  • Catering requests
  • Ground transportation

Failure to complete payment may result in cancellation.

5. Cancellations and Refunds

Cancellation terms vary depending on aircraft operator policies and timing.

  • Cancellation fees may apply.
  • Certain bookings may be non-refundable.
  • Weather, mechanical issues, or operational decisions made for safety reasons may require schedule adjustments.

Hogani Jets will make reasonable efforts to arrange alternatives when possible. Specific cancellation terms applicable to each booking are provided in the Charter Agreement and applicable Quote.

6. Passenger Responsibilities

Passengers agree to:

  • Provide accurate passenger and identification information
  • Comply with all applicable aviation security and safety regulations
  • Follow crew instructions at all times
  • Ensure possession of valid travel documents, visas, and identification
  • Notify Hogani Jets in advance of any pets, oversized baggage, hazardous goods, firearms, or medical equipment

Hogani Jets is not responsible for denied boarding due to incomplete documentation.

7. Prohibited Conduct

Passengers must not:

  • Transport illegal goods or restricted materials, including illegal drugs and medical marijuana
  • Engage in disruptive, threatening, or unsafe behavior
  • Violate aviation or international travel regulations
  • Smoke or vape on any aircraft

Operators may refuse transport, remove passengers, or divert flights if safety or compliance concerns arise.

8. Intellectual Property

All website content — including text, graphics, branding, logos, design elements, software, and functionality — is owned by Hogani Jets or its licensors and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works from any content without written permission from Hogani Jets.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Hogani Jets acts as an intermediary between clients and aircraft operators.
  • We are not liable for operational decisions, actions, or omissions of third-party air carriers.
  • Hogani Jets shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to lost profits, lost revenue, or damages arising from travel delays, cancellations, or circumstances beyond our reasonable control.
  • To the extent Hogani Jets is found liable for direct damages, such liability shall not exceed the total amount paid by the User to Hogani Jets in connection with the specific transaction giving rise to the claim.

10. Third-Party Services

Our website or services may include or reference third-party providers such as payment processors, aviation partners, hotels, ground transportation, or external platforms.

Hogani Jets is not responsible for third-party policies, actions, service performance, or their handling of your personal information. Your relationship with any third-party provider is governed by their own terms.

11. Privacy

Your use of the website is governed by our Privacy Policy and Cookie Policy, which explain how we collect, use, and protect personal information. By using the website, you consent to the collection and use of your information as described in those policies.

12. Force Majeure

Hogani Jets shall not be liable for failure or delay in performance caused by events beyond reasonable control, including:

  • Weather conditions
  • Air traffic control restrictions
  • Mechanical issues
  • Government actions, sanctions, or regulatory changes
  • Natural disasters
  • Security threats, terrorism, or civil unrest
  • Pandemics or pandemic-related restrictions
  • Labor disputes or strikes
  • Crew non-availability

13. Modifications to Services or Terms

We reserve the right to modify our services, update pricing structures, and revise these Terms at any time.

Updated Terms will be posted on this page with a revised effective date. Continued use of the website or services after such posting constitutes acceptance of the updated Terms.

14. Age Restriction

You must be at least 18 years old, or the age of majority in your jurisdiction, to use our services. Bookings made on behalf of minors require the consent of a parent or legal guardian.

15. Electronic Communications Consent

By using the website or requesting a quote, you consent to receive communications from Hogani Jets electronically, including by email, text message, WhatsApp, or other electronic means. You agree that all notices, disclosures, and agreements provided electronically satisfy any legal requirement that such communications be in writing.

16. No Warranty

The website and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Hogani Jets does not warrant that the website will be uninterrupted, error-free, or free of harmful components.

17. User Indemnification

You agree to indemnify, defend, and hold harmless Hogani Jets, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use or misuse of the website or services
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your infringement of any third-party right
  • Any misrepresentation or inaccurate information you provide

18. Governing Law, Dispute Resolution, and Waivers

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms, or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved by binding arbitration administered in Miami-Dade County, Florida, under the rules of the American Arbitration Association. The decision of the arbitrator shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Nothing in this section shall prevent either party from seeking emergency injunctive relief in a court of law where necessary to prevent irreparable harm.

Class Action Waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Hogani Jets.

Jury Trial Waiver. YOU AND HOGANI JETS EACH HEREBY WAIVE TRIAL BY JURY IN ANY JUDICIAL PROCEEDING TO WHICH BOTH ARE PARTIES INVOLVING, DIRECTLY OR INDIRECTLY, ANY MATTER ARISING OUT OF OR RELATING TO THESE TERMS.

19. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid, illegal, or unenforceable provision shall be replaced with a valid, enforceable provision that most closely reflects the original intent of the parties.

20. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and any applicable Charter Agreement, constitute the entire agreement between you and Hogani Jets regarding your use of the website and services, and supersede any prior or contemporaneous agreements, communications, or understandings.
